US Judge Mandates Release of Abrego Garcia from Immigration Detention

A federal judge has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment lacks legal authority.

"Since his return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his return to the United States to answer alien smuggling allegations, he was detained in immigration detention.

In her order, the judge pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

Background of the Case

The court challenge involve conflicting assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate trial in the state of Tennessee.

Terms of Release

The judge, who was overseeing his petition to deportation in a federal court, ruled that he must now comply with the terms of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
